1. Plan Your Passing is not a law firm

Plan Your Passing (the "Service," "we," "our," "us") is a publisher and software platform owned and operated by Number One Son Software Development. The author and operator is Roger Daniel Grubb, a licensed real estate professional in the State of Texas. Mr. Grubb is not an attorney, not a Certified Public Accountant, not a licensed financial advisor, and not a healthcare provider. No employee, contractor, or affiliate of Plan Your Passing is acting in any such capacity through this Service.

No attorney-client relationship is created by your use of this Service, your reading of any content on it, your use of any tool on it, your submission of any form on it, or your purchase of any product through it. The same is true for accountant-client, financial-advisor-client, and doctor-patient relationships.

2. Legal information vs legal advice

The content on this Service is legal information: general principles, plain-English definitions, descriptions of standard processes, illustrative examples, and scenario walkthroughs. Legal information is something anyone is free to publish.

The content on this Service is not legal advice: the application of law to your specific facts, circumstances, jurisdiction, and goals. Only a licensed attorney admitted to the bar in your jurisdiction can give you legal advice. The line between information and advice can be subtle. If a piece of content on this site appears to apply to your situation, that is your cue to get a real attorney involved before you act on it, not a substitute for doing so.

3. Jurisdictional disclaimer

Estate, probate, tax, and inheritance laws differ significantly by country, state, province, territory, county, and municipality. The Service is written from a United States perspective and is not adapted to non-US legal systems. Even within the United States, individual state and county variations can change the outcome of any specific question.

If you are accessing this Service from outside the United States, treat all content as informational only and consult an attorney or notary in your jurisdiction. If you are inside the United States, do not assume any state-specific page on this Service is current, complete, or accurate for your county or municipality. Verify with local counsel.

4. Laws change. Content may be out of date.

Statutes are amended. Courts issue new rulings that change interpretation. Tax codes change annually. Probate procedural rules vary by county and update frequently. We make best efforts to keep content current, but we make no guarantee. The "last updated" date on each major page is your best signal of currency. Any content older than 12 months should be considered presumptively stale and verified before relied upon.

5. AI-generated content (/tools/ask)

The AI question-and-answer tool at /tools/ask uses a large language model (currently Anthropic Claude) to generate answers to user questions.

  • AI outputs are generated by a statistical model and may contain errors, omissions, or "hallucinations" (confident-sounding incorrect statements).
  • AI outputs are not reviewed by an attorney before being delivered to you.
  • The AI cannot establish an attorney-client relationship.
  • The AI does not have access to current statutes, recent case law, or your specific facts beyond what you type in.
  • All AI outputs must be independently verified with a licensed attorney before any action is taken.

6. Generated documents (will-builder, advance directive, power of attorney)

The interactive tools at /tools/will-builder, /tools/advance-directive, and /tools/power-of-attorney produce starting drafts only. They are not finalized legal instruments. They are not signed, not witnessed, not notarized, and are not adapted to the specific signing, witnessing, notarization, recording, or filing requirements of any particular state, county, or municipality.

A draft from this site that is executed without review by a licensed attorney in your jurisdiction may be invalid, unenforceable, or have consequences you did not intend. Use the drafts as a starting point for a real conversation with real counsel, not as a substitute for one.

7. No warranty

The Service and all content on it are provided AS IS and AS AVAILABLE without any warranty of any kind, express or implied. We expressly disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, timeliness, currency, security, and uninterrupted availability. No advice or information obtained from the Service creates any warranty not expressly stated in these terms.

8. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Plan Your Passing, its author, Number One Son Software Development, or any of their respective officers, employees, agents, contractors, or affiliates be liable for any indirect, incidental, special, consequential, punitive, exemplary, or multiple damages, including but not limited to damages for lost profits, lost revenue, lost savings, lost data, lost goodwill, or business interruption, arising out of or in connection with your use of or inability to use the Service, regardless of the legal theory and regardless of whether we have been advised of the possibility of such damages.

In any event, the aggregate liability of Plan Your Passing for any and all claims relating to the Service shall not exceed the greater of (a) one hundred US dollars ($100) or (b) the total amount you paid to Plan Your Passing in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the above limitations apply to the fullest extent permitted by law.

9. Reliance

Any decision you make based on content or tools on this Service is solely your decision and solely your responsibility. Plan Your Passing is not responsible for any outcome, good or bad, of any action or inaction you take based on information found on this Service.

10. Third-party content and links

The Service contains links to and references third-party websites, attorneys, software, products, and services. Plan Your Passing is not responsible for the content, accuracy, terms of service, privacy practices, or any other aspect of those third parties. A link or reference is not an endorsement. Your interactions with any third party are solely between you and that third party.

11. Affiliate disclosure

Some links on the Service are affiliate links. When you click an affiliate link and complete a qualifying action, Plan Your Passing may receive a commission. This does not change the price you pay or the substance of our content. Full affiliate disclosure is available at /affiliate-disclosure.

12. Real estate content

The author of this Service is a licensed Texas real estate professional. Where the Service discusses real estate matters in the context of estate planning, the author may have a financial interest in real estate transactions unrelated to your specific situation. The Service is not a substitute for working with a licensed real estate professional in your state for any actual real estate transaction.

13. Healthcare content

Advance directive, living will, healthcare power of attorney, and end-of-life content on this Service is not medical advice. Consult your treating physician, palliative care team, or other licensed healthcare professional for medical decisions. Plan Your Passing makes no recommendation regarding any specific medical treatment or end-of-life care decision.

14. Financial and tax content

Discussion of estate tax, inheritance tax, gift tax, capital gains tax, step-up in basis, retirement account beneficiary designations, life insurance, annuities, IRAs, 401(k)s, and similar topics is not financial, investment, or tax advice. Consult a Certified Public Accountant, a tax attorney, a licensed financial advisor, or a fiduciary investment advisor for your specific situation.

15. SMS messaging (Telnyx)

If you submit your phone number through any form on this Service, you consent to receive transactional SMS messages from Plan Your Passing, sent through our messaging provider Telnyx. Message frequency varies based on the form you submitted. Text STOP at any time to unsubscribe. Text HELP for help. Standard message and data rates may apply through your wireless carrier. Carriers are not liable for delayed or undelivered messages.

16. Acceptance

By using the Service, you acknowledge that you have read this Disclaimer, that you understand it, and that you agree to be bound by it. If you do not agree, do not use the Service.
